Het nummer is geïnspireerd door de beslissing van de Supreme Court in de Verenigde Staten in de zaak van Brown tegen de Board Of Education. Volgens de wet waren openbare scholen verplicht om rassenscheiding toe te passen.
Het werd voor het eerst opgenomen door Pete Seeger in 1956, gevolgd door Sammy Davis Jr in 1957.
De oorspronkelijke tekst van het lied werd geopend met dit vers, in verwijzing naar de rechtbank:
Their robes were black,
Their heads were white,
The schoolhouse doors were closed so tight,
Nine judges all set down their names,
To end the years and years of shame.

Three Dog Night nam voor hun opname van Black & White de versie van The Spinners op hun album "Not Quite Folk" uit 1969 als uitgangspunt.
